Sam Ke Ting who was 27-year-old, was sentenced to six years in prison by the Johor Bahru High Court on April 13 for the killings of eight young people, has been permitted to appeal.
On Monday, Sam Ke Ting will file an appeal against a High Court verdict in the ‘leak’ bicycle case.
Sam Ke Ting, who was recently sentenced to six years in prison by the High Court for a traffic accident that killed eight teenagers on modified bicycles, has reportedly been given leave to appeal the High Court’s decision.
Sam’s appeal will be heard at 9 a.m. on Monday in the Court of Appeal in Putrajaya, according to Free Malaysia Today (FMT).
Sam was charged with reckless or hazardous driving after an accident in 2017 at 3.20 a.m. on Jalan Lingkaran Dalam in Johor Baru claimed the lives of eight cyclists.
According to reports, the accident involved a group of 30 youngsters who were riding lajak bicycles, which are customized bicycles with no brakes.
Sam’s counsel requested a stay of execution after the High Court sentenced him on Monday, but Judge Datuk Abu Bakar Katar denied it, citing the fact that they had not yet received consent from the Court of Appeal.
The following day, the lawyer, Faizal Mokhtar, used the court’s e-filing system to file a notice of application for leave to appeal and to postpone the execution of her sentence, as well as a certificate of urgency.
Stay of Execution
The decision of the judge not to issue a stay of execution has been criticized by MPs and the public, with many perceiving Sam as innocent and in a tough situation.
Several online petitions supporting Sam’s release have been created, with the largest garnering over 800,000 signatures at the time of writing.
The High Court’s decision had yesterday reversed the previous acquittal of Sam over the reckless driving charge sentencing her to imprisonment without allowing bail and also to an RM6,000 fine and a three-year driving ban upon completion of her prison term.
The decision came after the Magistrate’s Court in Johor Baru in October 2019 acquitted Sam without calling for her to enter defense as the court found that the prosecution had failed to prove a prima facie case, and after the same Magistrate’s Court in October 2021 again acquitted Sam as it found the prosecution had failed to prove its case beyond a reasonable doubt.
