Jesse Hooper, 12, from Otsego died in an all-terrain vehicle accident on July 16; Austin Copsey, 37, an Otsego man, was charged on July 19 with criminal vehicular murder for his involvement in the accident.
He could spend up to 10 years in prison, pay a $20,000 fine, or both for allegedly operating a vehicle carelessly and while intoxicated.
At 10:08 that evening, deputies were summoned to the scene of an off-road ATV crash at 14146 78th St. NE in Otsego.
According to the initial complaint submitted by the Wright County Sheriff’s Office, it was determined that the ATV was traveling at a high rate of speed westbound on 78th Street Northeast before entering the north side ditch based on evidence recovered from the scene and statements obtained at the scene. The Wright County Sheriff’s report states that the ATV looked to have rolled over after hitting the ditch.
A Polaris side-by-side ATV was discovered in the ditch by the deputies. According to the criminal complaint submitted in Wright County District Court, a section of mailboxes at the crash site had been destroyed, with fragments scattered all across 78th Street Northeast.
According to the complaint, law enforcement discovered that the ATV left the road and struck a collection of mailboxes that were all attached to a single post that was permanently anchored to the ground. The post was situated about 50 yards to the west in the middle of the road.
When he heard the crash, a witness who was questioned reportedly looked at his security camera and saw the ATV rolling many times in the ditch.
Hooper was discovered lying in the ditch and was later identified as a passenger. Due to injuries incurred in the ATV collision, he was declared dead at the site.
Copsey, the ATV’s owner and operator, was recognized at the scene of the collision. The allegation stated that he had a noticeable head wound, slurred speech, and a strong alcohol odor emanating from his breath.
Authorities think Copsey picked up his daughter to take her to the party after attending a neighborhood party and was driving with Hooper.

According to reports, the defendant was unable to recall what had occurred. According to the complaint, he alternated between telling a deputy that he was driving and that he wasn’t.
He had a preliminary breath test result of 0.19, which is more than double the legal limit for alcohol consumption.
Copsey was brought to Mercy Hospital to receive medical attention for his wounds.
Based on the likelihood that the defendant killed Hooper in a car accident by operating a vehicle carelessly and while intoxicated, a search warrant was obtained. According to the complaint, a crime lab has received the blood sample for analysis.
At his hearing on July 19, bail was set at $50,000 with no restrictions and $20,000 with conditions. Copsey will be heard again on August 5.
