Earlier this year, Raith Rover announced that they were signing David Goodwillie, who abused Denise Clair. The incident occurred in 2011. A New Year’s Eve party was held at the victim’s house with a friend in 2011, but she could not recall going to the nightclub in Bathgate after leaving the pub.
She also reported that many witnesses said she ‘wanted to go home due to her inability to stand up straight or talk correctly. But when she awoke the next day, she found herself in an apartment on Greig Crescent, near Armadale, without any clothes, and in pain.
It was discovered weeks after DNA evidence was collected from the swabs that she had s*xual contact with David Goodwillie that night. In January 2011, the player was arrested and charged with r*pe after admitting to having s*xual relationships with a woman.
On the other hand, the victim claimed alcohol had prevented her from freely consenting to intimacy. A sheriff’s court summons was issued to David after the accusations were made. The charges were dropped after insufficient evidence was found to justify prosecution in a criminal court.
In January 2017, details of the incident were heard in the Court of Session in Edinburgh after Denise Clair sued the footballers and waived her legal right to anonymity. Goodwillie was convicted in 2017 of r*pe in a civil court action filed in West Lothian and asked to pay £100,000 as compensation to the victim, a 24-year-old woman.
