The Supreme Court declined to consider the case on the grounds that Texas lacks constitutional standing to contest the results of an election conducted by another state under Article III of the Constitution. When House Minority Leader Kevin McCarthy’s office was evacuated by security during the 2021 Capitol riot, Westerman was left behind.
