(CBS) PHILADELPHIA — Philadelphia police confirmed Tuesday afternoon that the suspect in the tragic shooting inside Jefferson University Hospital on Monday morning will be charged with murder. Stacey Hayes, 55, is charged with murder, attempted murder, assault on a law enforcement officer, and other offenses.

Hayes had many firearms and ammo taken by the police in August of last year, according to court records acquired by Eyewitness News, but the items were ordered released to Hayes in June 2021.

A Smith & Wesson pistol, a pump shotgun, and an AR-15 were among the firearms, according to court papers. They had been in police custody for nearly ten months prior to the judge’s order.

The cause for the weapons confiscation from Hayes’ Wynnefield Heights residence is unknown according to court papers. Hayes claimed in his demand for the return of property that he bought the things legally. “I am not a threat to anyone,” he wrote, “and all I want is to be able to protect myself and my family if necessary.”

Judge Crystal Bryant Powell ordered the rifles and ammunition on June 3 and they were returned on June 23, according to court records. Her office told Eyewitness News she had no comment, but the city’s police union had plenty to say.

Hayes is suspected of assassinating his coworker, Anrae James, 42, and shooting two Philadelphia police officers early Monday.

She was wearing scrubs when he came up to the ninth floor of Jefferson University Hospital at 11th and Chestnut Streets in Center City just after midnight and shot and murdered James, according to authorities. Hayes, a licensed nursing assistant at the hospital, was wearing body armor and equipped with multiple firearms, including an AR-15, according to investigators.

“What happened at Jefferson was a tragedy, and we mourn the loss of that gentleman,” Hoyt added. “But thank God we didn’t lose any more people, especially police officers from Philadelphia.”

Officials say Hayes then fled in a U-Haul vehicle. Officers were dispatched to Parkside in West Philadelphia, where they discovered Hayes holding a huge pistol, and a shootout followed in a wooded area near School of the Future on the 4000 block of Parkside Avenue, according to authorities.

Hayes was shot twice, according to police, but not before injuring two cops.

“Overall, spirits are high, and we’re quite pleased with them,” Hoyt added. One officer has returned home, while the other remains in the hospital. He’s had surgery before, and he’ll have another today. I mean, this is a serious injury. It’ll take a long time to get back on track.”

Hayes is still in the hospital, according to authorities.

The motivation for the tragic shooting on Monday is yet unknown.

A GoFundMe page was set up by the James family. Anrae is described as his children’s and wife’s hero on that page. He worked two jobs and was quite involved in his children’s life, according to the report. His wife told Eyewitness News that she is heartbroken over the fact that her children would grow up without their father.
