According to The Associated Press, the execution took place without the presence of any journalists. The Associated Press also said, a prison spokesperson did not receive a phone call informing him that it was time to bring reporters to the prison, so they waited at an office across the street while the execution took place.
In a statement to the Associated Press, a representative for the Texas Department of Criminal Justice said, “The Texas Department of Criminal Justice can only apologize for this error and nothing like this will ever happen again.”
According to court documents, Jones was convicted in 1999 of murdering his 83-year-old great-aunt Berthena Bryant with a baseball bat after she refused to give him $30 for drugs. He had been on death row since 2001, when he was sentenced to death in Tarrant County.
Because of COVID-19, the Texas Court of Criminal Appeals issued several stays of execution in 2020. Jones’ death is the state’s first execution since July 8.
Quintin’s crime was forgiven by his family.
The convicted murderer and his family had argued that he had been forgiven by relatives, was “remorseful,” and had “transformed for the better” during his decades in jail.
Bryant’s lone living sibling, Mattie Long, claimed in a clemency plea, “He is not the same guy and has grown up.” “Quintin is unable to resurrect her. I won’t be able to resurrect her. I’m writing to request that you spare Quintin’s life.”
Benjamin Jones, Jones’ twin brother, described their chaotic childhood, stating they grew up with no positive role models and sought out trouble with little supervision.
“Please don’t make us victims again by putting Quin to death,” the prisoner’s brother wrote.
“Clemency for Quintin”
Prior to his execution, a petition termed “Clemency for Quin” had gathered over 170,000 signatures.
Jones’ clemency request was denied by the Texas Board of Pardons and Paroles on Tuesday. Michael Mowla, his lawyer, suggested that race was a factor, citing a similar case in which the same board acquitted Thomas Whitaker, a White man convicted of murdering his mother and brother. Mowla then petitioned the United States Supreme Court for a stay of execution and a reprieve for Jones.
“The lack of consistency in the application of grounds for clemency — where clemency was recommended and granted for Whitaker, who is White, but denied for Mr. Jones, who is Black — offers a constitutionally cognizable argument that Mr. Jones’s race had an improper part in the board’s denial of his application for mercy,” Mowla wrote in court.
The request was turned down.
