In the Cradle Fund CEO murder trial, Samirah and two other minors were released.

Samirah Muzaffar and two teens were cleared by the High Court of murdering her husband, Cradle Fund CEO Nazrin Hassan, four years ago. The prosecution had failed to establish a prima facie case against them, according to Judge Ab Karim Ab Rahman.

On June 14, 2018, Samirah, 47, the two teenagers, now 19 and 16, and Indonesian maid Eka Wahyu Lestari, who is still at large, were accused with murdering Nazrin at their house in Mutiara Damansara. Karim ruled that the prosecution failed to show that Nazrin died between 11.30 p.m. on June 13, 2018 and 4 a.m. on June 14, 2018.

“The prosecution stated that the deceased died during this time but testimony from his sister (Che Elainee Che Hassan) stated that he (Nazrin) saw her message at 11.50pm.

“There is no direct evidence that they (Samirah and the two teenagers) committed the offence,” he said. He claimed the prosecution just “assumed” Samirah and the teenagers were present when Nazrin died. He also said the prosecution tried to accuse Samirah by claiming she did not call the fire department and was not “sorry” when her husband died.

“However, her actions were merely the prosecution’s perception,” he said.

Unclear Motive

The judge also said the motive in Nazrin’s murder was “unclear”. “The prosecution tried to imply that (insurance) money was behind it, but at the same time, they admitted in their submission that the motive in this case was unclear,” he said. Following the proceedings, lead counsel Shafee Abdullah told media that the defense was ready in case the acquittal of Samirah and the teens was challenged by the Attorney-Chambers General’s (AGC).

“If there is an appeal, we will stand a chance to win because we think the decision will be maintained,” he said. Nazrin’s brother, Dr Abdul Aziz Che Hassan, told reporters they hoped the AGC would file an appeal against the ruling. “If they do not do so, we will ask for an inquest to determine his cause of death,” said Aziz, who was present in court with other family members.

The murder trial for Nazrin began on September 6, 2019 and ended on April 22, 2019.

Aziz, Che Elainee, and two pathologists – Dr Siew Sheue Fong and Dr Prashant Sanberker – who conducted two independent post-mortems on Nazrin’s remains – were among the 57 witnesses presented by the prosecution.

During his time at Cradle, Hassan was a driving force behind the Malaysian Angel Tax Incentive. He was the secretariat chairman of the Malaysian Business Angel Network (MBAN), which he helped to establish. He was a member of the Malaysian Technopreneurs Association (TeAM).

From April 2014 to February 2015, he served on the board of the Malaysian Global Innovation & Creativity Centre (MaGIC).

 Hassan was on the board of Cradle Seed Ventures (CSV), Cradle’s venture capital arm, until his death.
