Mr. Roberts claimed Navasia Jones was beating on all her neighbors’ doors on the 10th floor around 7:45 a.m. on Tuesday, crying, “My baby can’t breathe!” My child is gasping for air!” “My daughter isn’t breathing!” and “My daughter isn’t breathing!”

He admitted that he did not open the door right away, but that after a few minutes, he ventured into the corridor and observed several emergency medical technicians in Julissia’s bedroom pumping her chest. Ms. Jones lost custody of her four elder children in 2013, a year before Julissia was born. In a case that was the subject of a state appellate court judge, she lost custody of Julissia shortly after she was born in 2014.

The Administration for Children’s Services filed an appeal after a family court judge granted Ms. Jones custody of Julissia, claiming that Julissia’s safety was jeopardized by Ms. Jones and Julius Batties’ failure to exercise a “minimum degree of care.”

Appellate judges ruled in favor of the child welfare agency in 2015, finding that Ms. Jones was still “prone to unpredictable emotional outbursts,” even on supervised visits with her older children, and was “easily provoked and agitated,” despite completing mandated parenting skills and anger management programs.

“We cannot agree” that returning Julissia, “even with the safeguards imposed by the family court, would not present an imminent risk” to her life or health until the mother is able to successfully address and acknowledge the circumstances that led to the removal of the other children,” the judges wrote.

The Administration for Children’s Services, citing confidentiality laws, refuses to comment on the matter. Ms. Jones’s attorney, who has represented her in family court issues, declined to comment.

Ms. Jones regained custody of Julissia conditionally about 16 months ago and permanently a few months ago, according to Brian Zimmerman, a lawyer for Mr. Batties, who is estranged from Ms. Jones. Julissia had previously lived with her paternal grandmother, according to him, and there had been years of litigation over whether Julissia should live with Ms. Jones or the grandmother, some of which was still going on.
