Eastman and Clark are not facing any criminal charges. Inquiries for comment have gone unanswered from Clark’s lawyers. On Monday, a representative of the DOJ Inspector General’s office declined to comment.

Six Federal Approached Eastman

According to court documents, on Wednesday, roughly six federal investigators approached Eastman as he was leaving a restaurant in New Mexico with his wife and a friend. Eastman’s court document, he was patted down and “forced to produce [facial] biometric data to open” the phone. According to the documents, agents were able to access Eastman’s email accounts on his iPhone 12 Pro.

Eastman is the most recent person whose communications have been included in major Justice Department investigations into the attack on the US Capitol on January 6, 2021. The agents, according to Eastman, “forced” him to open his phone. He is requesting that a federal judge ordered the Justice Department to hand over his belongings, destroy any documents they have gathered, and halt investigators’ access to the phone in court.
