A seventeen-year-old boy reported to police in March 1998 that Fashanu had sexually abused him after a night of drinking. At the time, homosexual acts were illegal in the US state of Maryland,[4], and the youth indicated that the act was not consensual but was conducted when he awoke.  Fashanu’s flat in Ellicott City, Maryland, is said to have been the scene of the assault. On April 3, police questioned Fashanu about it, but he was not taken into custody. Fashanu had already gone to England when the police arrived at his flat with a warrant to arrest him on allegations of second-degree sexual assault, first-degree assault, and second-degree assault.

He was discovered hanging in a derelict lock-up garage he had broken into in Fairchild Place, Shoreditch, London, on the morning of May 3rd, after attending Chariots Roman Spa, a local gay sauna. He contested the charges in his suicide note, claiming that the sex was consensual and that he had fled to England because he believed he would not be given a fair trial because of his homosexuality, and he added: “I realized I’d already been charged with a crime. I don’t want to shame my friends and family any further.”

The Americans made no request for Fashanu to be found or arrested, according to a Scotland Yard investigator, and the Coroner stated that he was not a wanted man at the time he hanged himself during an inquest held in London on September 9th. According to the New York Times and the BBC, Howard County District Court issued an arrest warrant on 3 April, charging him with second-degree sexual assault and first- and second-degree assaults punishable by up to 20 years in prison, and Howard County police would have requested his extradition if they had known he had fled to England. Suicide was determined by the inquiry.

Fashanu’s ashes were cremated at City of London Cemetery and Crematorium, and a brief memorial service was performed.
