“Due to the courts’ continued safety constraints during the pandemic, we were only recently granted permission to submit evidence to the Grand Jury for their consideration. They deliberated and concluded that there is probable cause to believe the Daybells willfully and knowingly conspired to commit multiple crimes that resulted in the deaths of three innocent people.”

Vallow and Daybell’s attorneys did not immediately respond to a request for comment. Tylee was last seen on the 8th of September, 2019. According to authorities, police were able to find a picture from that day of Tylee on a trip to Yellowstone National Park with Vallow, Vallow’s brother, Alex Cox, and Joshua.

Joshua, who had special needs, was last seen alive on September 23, 2019 at Rexburg’s Kennedy Elementary School. When police arrived at Vallow’s house in November to perform a welfare check at the request of his grandmother, Joshua was nowhere to be found.

However, according to Rexburg police, Vallow and Daybell never reported the children missing and did not cooperate with authorities until fleeing the state. Authorities gave Vallow until the end of the month to “physically produce her kids” after they were discovered in Hawaii in January 2020. She did not, and she was charged with two counts of desertion and failure to provide care for dependent children.
