The assault continued for more than half an hour, during which bystanders allegedly did not intervene but instead filmed the distressing scene on their phones. It was not until an off-duty transit worker called 911 at 9:52 PM that authorities were alerted to the incident.

The actions, or lack thereof, of the bystanders on the train, have ignited a debate over their culpability in the incident. While police initially suggested that the witnesses who filmed the assault could face criminal charges, the Delaware County District Attorney’s office clarified that their focus is on prosecuting the perpetrator rather than the witnesses. The district attorney’s spokesperson emphasized that witnesses who come forward to assist in bringing Ngoy to justice would not be prosecuted for their recordings.
